POLITICS OR THE THEATER OF THE ABSURD!!!

Politics has always been boring for me and I am almost sorry that I tuned in to it on an almost daily basis after the miraculous election of Trump. I never have liked politicians since I always knew that they sold their souls to the highest bidder. Up until the Trump presidency there was at least a semblance of some order on a daily basis and I just viewed politics as a rather mundane excursion into dysfunctional government.

With the election of Trump politics has been turned into a theater of the absurd. Absurd to spend over 2 years and about 35 million to prove there was no collusion or treason with Russia and absurd to continue the drama with subpoenas of individuals and subpoenas for information without probable cause of any stated criminal activity. This is just tantamount to a never ending harassing fishing expedition. A congressional oversight committee has been turned into a harassment committee delusionally hoping to uncover high crimes and misdemeanors but not having the slightest clue which high crimes they are talking about.

Yes, Trump is an embarrassing amateur politician with good intentions but relative incompetence when it comes to substantive follow through on the good intentions. But is that any reason to vehemently oppose anything that he says or tries to do just because you basically hate his guts?  He does have the guts of a fighter even though you can sometimes say that he doesn’t fight fair and can throw around political mud with the best of them!

The almost 20 Democratic candidates for president are also mostly absurd 3 old farts and the rest relative newbies with minimal executive experience. All of the candidates are cannibalizing each other and no one really has that much charisma. I am so disappointed that I am tempted to turn off the theater of the absurd and only return back on about election day in 2020.

Will any progress be made in the next year and a half? I sincerely doubt it and it will probably be the same old BS up until election day.

THE TRUTH ABOUT VERDICTS+

Verdict: n. formal recorded judgment of a jury of peers and/or judge by communicating guilty or not guilty on different count(s) presented during a criminal and/or civil prosecution

 

With an official verdict you are guilty or innocent of a legal prosecution.

 

I foresee a time in the future when someone will be declared 60% to 80% guilty or innocent of an official offense because the reality is that you may only be a percent guilty of an offense or not guilty of it by a percentage.

 

The yes or no approach to justice these days is frequently unjust and I look forward to the day when computer judges will hand down percentage guilty or innocent verdicts too because in life there is in reality no certainty all the time and it is frequently an attempt to fit a round peg into a square hole to use a geometric analogy.

 

An example: You quickly went through a red light with no cars on the intersection and no speeding cars 100 meters from both left and right sides of the intersection. You are guilty only for about 1% of the crime of going through a red light and should be fined 99% less by an observing camera or no fine at all should be assessed! That is true real justice and will increase the efficiency of too much traffic congestion and waiting and wasting gasoline without probable cause for “endangering the safety of” the public!

 

Waiting for a light to change from red to green at night at about 3 in the morning with no visible traffic for 100 meters is also not a crime with a probable cause for “endangering the safety of” the public!

THE TRUTH ABOUT REASONABLE SUSPICION*

Suspicion: n. judging intuitively with little evidence that a subset(s) is a probable cause of an event(s) in the past and/or the future

 

Guess: v. to make a judgment and/or estimation without adequate knowledge for certainty

 

Hunch: n. bad intuitive guessing usually not based on adequate facts

 

REASONABLE SUSPICION: n. A subjective intuitive guess that a subset(s) (has a higher than 50% probability of existence and/or is a probable cause of an event(s) in the past and/or the future)

 

Humans are not statistical mathematical machines who can calculate statistical probabilities and differentiate between a chance 50% occurrence and one greater than a chance occurrence. Most human judgments by law enforcers are made based on prior experience under similar circumstances and are largely probable guesses based on prior experience(s).

It is foreseeable that in the future robot policemen will be doing police word so I left in the 50% part of the definition so that computer policemen of the future will be able to make statistical probability guesses based on the evidence. However, such a situation is far into the future so most policemen should not worry that their jobs will soon be in jeopardy like all the other jobs being discontinued in society due to obsolescence.

 

A new officer of the law is less competent to make a judgment of reasonable suspicion than an experienced officer and will make a larger number of mistakes in judging reasonable suspicion. Reasonable suspicion is an intuitive guess that something exists.

 

Are all officers of the law are equal in competence to assess reasonable suspicion? No, the seasoned veterans are the ones most qualified to make guesses about probable law breaking or criminal behavior.  Are all officers equally competent to make decisions in the field? No.

 

If you are a young and inexperienced officer starting out then you are not equal in competence to one that has been on the police force for 10 or 20 years observing and evaluating human behavior. A young officer will make worse guesses about what is actually going on in reality and that is his or hers major weakness or flaw in starting out in the profession.

 

As a young officer starting out and asked what the probable cause for being stopped and interrogated is? He or she will be less competent in coming up with the right reason(s) and the reasons must be more certain than just hunches or bad guesses.

 

What is the probable cause and how many years have you been on the police force are two questions which are very valid and must be answered by any officer of the law if asked.

 

Open container laws are unjust and just because there is an open container of beer or wine with any amount of drink in it does not mean that you should be subject to a fine because the ultimate test is a breath test to see if the human has exceeded the legal limit for drinking behind the wheel or not.

 

In the near future a request by an officer to take a breathalyzer test for weaving in traffic with an open container will have to be obeyed since factual proof is necessary before any fine is assessed.

 

I personally like to drink some beer while driving rather than soda or some other drink and I should not have to put up with overly zealous onlookers calling 911 to notify the police that someone is drinking an alcoholic beverage behind the wheel of a car and wasting taxpayer’s money by making an officer stop the vehicle or follow it. I don’t like to secretly drink beer within a bag to hide the fact that I am drinking an alcoholic beverage behind the wheel.

 

There is a great difference between drinking while driving and being drunk while driving! Sipping a beer behind the wheel is probable cause for stopping someone and interrogating them? No. There is not even reasonable suspicion unless the driver is also violating some other factual traffic law like driving too slow and much under the speed limit.

 Probable cause: n. the reason(s) as objective and/or factual as possible for an arrest and/or bodily seizure

 

Asking an officer what is the probable cause of the arrest and/or bodily seizure is really asking the question what is the reason for the arrest and/or bodily seizure. The officer has an obligation to answer this question with as objective and/or factual a reason(s) as possible. Probable cause is just a fancy name for the need to answer the question-Why are you arresting me? If the officer can’t answer the reason for the arrest then there is no reason or no probable cause and no arrest can be made.

There is nothing abstract about the concept of probable cause because an abstraction is not logical and/or factual and shouldn’t exist as a concept if it is abstract.
